Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CamNotes website at camnotes.com and the CamNotes mobile application (collectively, the "Service") operated by CamNotes ("we," "us," or "our"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have your parent or guardian's permission. By using the Service, you represent that you meet these requirements.

2. Accounts

When you create an account or join the waitlist, you agree to provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Upload content that infringes intellectual property rights, is defamatory, obscene, or otherwise objectionable.
  • Attempt to reverse-engineer, decompile, or extract source code from the Service.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Use automated systems (bots, scrapers) to access the Service without our written permission.
  • Resell, redistribute, or sublicense the Service or any content generated by it.

4. Your Content

You retain ownership of all content you upload to the Service (photos, notes, text). By uploading content, you grant us a limited license to process, store, and display it solely to provide the Service to you. We do not use your content to train AI models or share it with third parties except as needed to operate the Service (e.g., OCR processing).

5. AI-Generated Content

The Service uses artificial intelligence to generate summaries, flashcards, quizzes, and other study materials from your content. AI-generated output may contain errors or inaccuracies. You are responsible for reviewing and verifying any AI-generated content before relying on it. We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any purpose.

6. Free Tools & Paid Plans

Some features of the Service are available for free; others require a paid subscription. Pricing, features, and usage limits for each plan are described on our pricing page and may change with notice. Free tools may have usage limits that reset monthly.

7. Payments & Billing

Paid subscriptions are billed in advance on a monthly or annual basis depending on the plan you select. You authorize us to charge your payment method on each billing date. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.

8. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by CamNotes and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without written permission.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, CamNotes and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months before the claim arose, or $50, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless CamNotes from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.
